Further clarifications concern the need to identify the beneficiaries of omnibus accounts and the requirement that the SCV procedures be in scope of the internal audit function. The introduction of the Law of 18 December 2015 on the failure of credit institutions and certain investment firms (Law of 2015) requires updating the use of obsolete terms such as AGDL by referring to either the Fonds de garantie des dépôts Luxembourg (FGDL) or the Conseil de protection des déposants et des investisseurs (CPDI). However, the principles and practices of Circular CSSF 13/555 have been maintained as far as possible. All modifications are presented in the amended version of Circular CSSF 13/555 as “track changes”. All amendments, except for addition of a 17th column to the SCV file, will enter into force on the date of publication of this circular. The addition of the 17th column to the SCV file shall enter into force on 1 September 2023. The AGDL played a key role in the compensation of retail depositors with credit institutions which had to be liquidated or had to find a purchaser during 2008 and 2009.
