Keywords: Crypto-assets.</p>\n<h2>Text</h2>\n<p>Circular CSSF 25/885 Application of the Guidelines of the European Banking Authority on templates to assist competent authorities in performing their supervisory duties regarding issuers’ compliance under Titles III and IV of Regulation (EU) 2023/1114 (EBA/GL/2024/16)</p>\n<p>Circular CSSF 25/885 Application of the Guidelines of the European Banking Authority on templates to assist competent authorities in performing their supervisory duties regarding issuers’ compliance under Titles III and IV of Regulation (EU) 2023/1114 (EBA/GL/2024/16) To all the issuers, as defined in point (10) of Article 3(1) of Regulation (EU) 2023/1114 1 (“MiCAR”), of asset-referenced tokens (“ARTs”) and e-money tokens (“EMTs”) as defined in Article 3(1), points (6) and (7) of MiCAR.</p>\n<p>Luxembourg, 30 April 2025 Ladies and Gentlemen, The purpose of this circular is to inform you that the CSSF, in its capacity as competent authority, applies the Guidelines of the European Banking Authority (“EBA”) on templates to assist competent authorities in performing their supervisory duties regarding issuers’ compliance under Titles III and IV of Regulation (EU) 2023/1114 (Ref. EBA/GL/2024/16) (the “Guidelines”), published on 18 December 2024. Consequently, the CSSF has integrated the Guidelines into its administrative practice and regulatory approach with a view to promoting supervisory convergence in this field at European level.</p>\n<ol>\n<li>The Guidelines The Guidelines are issued by the EBA pursuant to Article 16 of Regulation (EU) No 1093/2010. The Guidelines apply as from 26 May 2025. These Guidelines specify the content and uniform formats for the submission of information used by competent authorities when exercising their supervisory powers under Article 94(1)(a) and Titles III and IV of MiCAR and by the EBA when exercising its supervisory powers under Article 122 of that regulation.
