Keywords: Crypto-assets.</p>\n<h2>Text</h2>\n<p>Circular CSSF 25/889 Application of the Guidelines of the European Securities and Markets Authority on the specification of Union standards for the maintenance of systems and security access protocols for offerors and persons seeking admission to trading of crypto-assets other than asset-referenced tokens and e-money tokens (ESMA75223375936-6132)</p>\n<p>Circular CSSF 25/889 Application of the Guidelines of the European Securities and Markets Authority on the specification of Union standards for the maintenance of systems and security access protocols for offerors and persons seeking admission to trading of crypto-assets other than asset-referenced tokens and e-money tokens (ESMA75223375936-6132) To all the offerors as defined in Article 3(1), point (13) of Regulation (EU) 2023/1114 1 (“MiCAR”) and persons seeking admission to trading of crypto-assets other than asset-referenced tokens or emoney tokens as defined in Article 3(1), points (6) and (7) of MiCAR.</p>\n<p>Luxembourg, 30 April 2025 Ladies and Gentlemen, The purpose of this circular is to inform you that the CSSF, in its capacity as competent authority, applies the Guidelines of the European Securities and Markets Authority (“ESMA”) on the specification of Union standards for the maintenance of systems and security access protocols for offerors and persons seeking admission to trading of crypto-assets other than asset-referenced tokens and e-money tokens (ESMA75-223375936-6132) (the “Guidelines”), published on 26 February 2025. Consequently, the CSSF has integrated the Guidelines into its administrative practice and regulatory approach with a view to promoting supervisory convergence in this field at European level.</p>\n<ol>\n<li>The Guidelines The Guidelines are issued by ESMA on the basis of Article 14(1), point (d), of MiCAR pursuant to Article 16 of Regulation (EU) No 1095/2010. The Guidelines apply as from 27 April 2025. The Guidelines, prepared in cooperation with the European Banking Authority, are based on Article 14(1), point (d), of MiCAR. The purpose of these Guidelines is to specify the appropriate Union standards for offerors and persons seeking admission to trading as regards the maintenance of systems and security access protocols, including policies and procedures. These Guidelines also aim to promote greater convergence in the interpretation and application of the MiCAR provisions applicable to offerors and persons seeking admission to trading of crypto-assets other than assetreferenced tokens or e-money tokens.
