\nThe Chamber debated the bill 8486 amending the Penal Code and the Code of Criminal Procedure, which widens the mini-instruction and requires judges to give special reasons for refusing a suspended sentence below two years; it was adopted by 40 votes to 8 with 12 abstentions, and a motion by Laurent Mosar asking the government to review access to the criminal file in the name of the rights of the defence was adopted unanimously by show of hands.

Under the new rule the judge can only impose a prison sentence of under two years without suspension if he gives special reasons for it.

Instead of prison being the exception and the alternative measure the rule, this bill makes prison the rule again and the alternative to prison the exception.
